Trump's arraignment on 37 charges related to retaining sensitive documents has fueled demands for similar charges against Biden.
Over the past year, multiple sets of classified documents, some reportedly from Biden's time in the Senate, have been discovered in the president's possession. These discoveries include documents found at the Penn Biden Center in Washington, D.C., and in his Wilmington, Delaware garage. Attorney General Merrick Garland appointed Hur as special counsel to oversee the Biden investigation in January.

Fox News contributor and George Washington University law professor Jonathan Turley highlighted the key question: will Hur aggressively investigate potential false statements by President Biden, and has he requested a presidential interview? Turley pointed out the illogical nature of Biden's explanation regarding the documents, noting their apparent movement and division, with one allegedly found near his library. He emphasized that the Senate documents would have required removal from a secure facility by then-Senator Biden, suggesting purposeful action and awareness.

Turley further argued that Hur could shield Biden by avoiding a direct interview or statement, but the public will be watching for the same aggressive approach displayed by Special Counsel Jack Smith in the Trump investigation, especially given the illegality of lying to federal investigators.
Former Assistant U.S. Attorney Andy McCarthy advocated for Biden to receive the "same treatment" as Trump in a New York Post op-ed. He urged House Judiciary Committee Chairman Jim Jordan to subpoena both Hur and FBI Director Christopher Wray, demanding details about the documents Biden stored in unauthorized locations. McCarthy specifically highlighted Biden's Wilmington home and his private office at a University of Pennsylvania think tank, drawing attention to alleged Chinese funding for the latter.
