Federal Prosecutor Seeks Control of Rikers Island Jail Complex Amid Ongoing Crisis

Manhattan’s U.S. Attorney announced his office's intention to seek court-appointed receivership of Rikers Island jail complex, wresting control from New York City Mayor Eric Adams' administration. U.S. Attorney Damian Williams cited a "collective failure" spanning multiple administrations, emphasizing the urgent need for substantial progress after eight years of attempted reforms. Mayor Adams has previously resisted federal intervention, asserting his administration's efforts to stabilize the pandemic-stricken facility. A City Hall spokesperson questioned the timing of the move, highlighting positive impacts of the city's efforts.

Dating back to 2015, a consent decree addressed constitutional rights violations of inmates at Rikers. Despite an action plan, a July 2023 monitor's report found insufficient progress in reducing harm to inmates and staff. The report highlighted stagnant reforms, unreported violence, and deplorable conditions, including mold and vermin infestations.

The U.S. attorney’s office is now pursuing contempt proceedings and seeking a receiver with independent authority to enforce the consent decree. If appointed, the receiver would report directly to the court. In June, U.S. District Judge Laura Taylor Swain directed discussions about a potential receivership structure, with consideration expected in August. Advocates for Rikers detainees, citing 19 deaths in 2022, 16 in 2021, and six so far in 2023, have strongly advocated for federal oversight. The Legal Aid Society applauded the move towards federal control, expressing hope for an end to the "culture of brutality."
