The recent Supreme Court ruling in 303 Creative v. Elenis marks a pivotal moment for free speech in the United States. This landmark decision affirms that all individuals, regardless of their beliefs, have the right to express themselves freely without government coercion. It's a victory not just for me, but for everyone who values the First Amendment.
The Court's message is clear: America is a diverse nation where freedom of thought and expression are paramount. Whether you're an atheist or a Christian, a Democrat or a Republican, a supporter or opponent of same-sex marriage, you have the right to speak your mind. Disagreement is inevitable in a pluralistic society, but disagreement does not equate to discrimination. The government cannot silence individuals by mislabeling their speech as discriminatory.

Unfortunately, misinformation has clouded the narrative surrounding this case. Let me clarify: I serve everyone, regardless of their sexual orientation, and have clients who identify as LGBT. My decisions about which projects to undertake are based on the message being requested, not the person making the request. Certain messages I decline to create, including some political messages and those that disparage individuals, including those who identify as LGBT. This principle has been consistently upheld by Colorado, the lower courts, and now the Supreme Court.
The Supreme Court has explicitly affirmed that this decision does not sanction discrimination against anyone. No one will be compelled to express views they don't hold. The Court’s ruling safeguards the freedom of expression for all.

My pre-enforcement lawsuit was filed because Colorado was infringing upon my constitutional rights. I chose this path proactively, knowing that Colorado could penalize me for creating art that reflects my beliefs about marriage, as they did with cake artist Jack Phillips. I sought to protect my right to free speech, not to discriminate.
Despite this victory, I have been subjected to hateful attacks and threats. My website was inundated with malicious messages and offensive requests. Yet, I remain committed to the principle of defending freedom for all, even for those who disagree with me. The Supreme Court’s decision protects their free speech rights as well.
As someone whose views on same-sex marriage have evolved, I understand the importance of being able to express one's beliefs freely. While my perspective has changed, I want others to have the same freedom I sought to protect. This freedom is the cornerstone of our democracy, distinguishing it from oppressive regimes. Let us strive to treat each other with respect and recognize that this ruling expands freedom for all Americans.
