A letter filed by Lively's team highlights these concerns and references the released footage, which both sides interpret as supporting their claims.

Sources close to Baldoni find a gag order unjust, especially given his claim of defamation by a New York Times article, which he alleges has caused significant professional and financial damage. Baldoni's aim, according to the source, is to present videos and text messages to refute the accusations against him. They find it contradictory that Lively would initiate accusations and then seek to silence Baldoni's defense.

Baldoni previously filed a substantial lawsuit against Lively and her husband, Ryan Reynolds. The released video purportedly addresses Lively's claims about a specific slow-dance scene where she alleged Baldoni made inappropriate comments and physical contact. Baldoni contends the interaction was related to Lively's spray tan and taken out of context. The released footage, according to a statement accompanying it, shows the actors behaving professionally within the scene's parameters.

Lively's legal team, however, insists the video supports her allegations, describing it as "damning evidence." They argue the footage displays Baldoni making unwanted advances, touching Lively without consent, and improvising actions not previously discussed or approved.
