California School District Suspends Students for Misgendering, Implements Restorative Justice

Two students at Herbert Hoover High School in Glendale, California, were recently suspended for five days following a misgendering incident. According to an email from the former principal, Jennifer Earl, the students also underwent "restorative justice" training. The incident involved the students misgendering a transgender classmate and then leaving the classroom as the teacher attempted to correct them. Earl's email, reviewed by Fox News Digital and initially reported by GUSD Parents Voices, stated that the students admitted to being curious about transgender individuals during their interviews.

The email indicates that the teacher involved requested that the principal educate the students about transgender issues, a request that Earl fulfilled, reportedly to the satisfaction of both students and parents. The restorative justice training was conducted after the suspension period. The Glendale Unified School District (GUSD) clarified to Fox News Digital that disciplinary actions for misgendering depend on the perceived intent and whether the incident escalates to harassment or bullying. Accidental misgendering does not typically result in punishment.

GUSD's website defines restorative justice as a process aimed at re-educating students and helping them regain control after causing harm. It involves posing "barrier-breaking" questions to explore personal values and perspectives. The district's restorative justice program aims to address the root causes of conflict, ensure accountability, and promote healing for those affected, thereby restoring a sense of community.

GUSD emphasizes that they collaborate with parents to foster inclusive learning environments and adhere to California state laws and Department of Education policies. The district’s definition of restorative justice includes addressing physical needs, which, according to GUSD, encompasses "sexual expression." This incident raises questions about the balance between supporting transgender students and protecting the free speech rights of other students.
