A federal grand jury has indicted two militia members, Bryan Perry of Clarksville, Tennessee, and Jonathan O’Dell of Warsaw, Missouri, on 44 counts related to a plot to attack Border Patrol agents and migrants at the U.S.-Mexico border. The indictment alleges that the men planned to open fire on migrants crossing the border and target any Border Patrol agents who intervened. They face charges including attempted murder of FBI agents, assault with a deadly weapon, and using a firearm in furtherance of a crime of violence.

The alleged scheme began in 2022 with the men's efforts to recruit others into their self-proclaimed militia. They used O’Dell’s home as a base, gathering firearms, ammunition, and other equipment. Perry posted videos online expressing anti-government sentiments, claiming Border Patrol was committing treason by allowing migrants into the U.S. He declared their intent to "go to war" and "shoot to kill" to "protect this country."

By October 2022, they had amassed an arsenal that included six guns, 23 loaded magazines, body armor, and explosive materials. Perry stated in a phone conversation that they intended to "start a war" at the border. When the FBI attempted to apprehend them, the suspects fired upon agents, with Perry allegedly discharging 11 rounds. Agents did not return fire and subsequently arrested the two men, who are now in federal custody without bond, deemed a danger to the community.
This incident coincides with ongoing challenges at the border, with the recent appointment of Jason Owens as the new Border Patrol Chief, replacing Raul Ortiz.
